Judge Chitty Postpones Pate Transportation vs. the City of Forney Trial

Providing only a slight reprieve, case #83445-422, Pate Transportation Partners, LP and Forney Roadbuilders, LP vs. the City of Forney, Darren Rozell and Brian Brooks was very recently postponed, until April 30, 2013.

Presiding Judge, B. Michael Chitty became unavailable to begin the trial which was scheduled for this coming Tuesday, February 26, 2013. Judge Chitty has rescheduled the proceeding as a four day trial which will begin on April 30th, and possibly last through May 3, 2013.

Persons of interest who have been deposed and/or subpoenaed for this trial include former, City of Forney Public Works Director, Michael Ray Shook, who was employed with the city throughout the development and implementation of the Forney Pass-through Toll Project, and TxDot Dallas District Engineer, Bill Hale.

Considering that early voting for the May General Election begins on Monday, April 29, 2013 and continues through the week, this looks to be a very busy time for the Forney City Council.
